Indemnity and Release
Except where provided or required by law and as such cannot be excluded, I agree that it is a term of my registration – participation or volunteering – that for myself, my executors, administrators, heirs, next of kin, successors and assigns, I hereby:
(a) Waive and release all claims that I may have against the organiser, volunteers, and other accredited supporters (“the releasees”) involved in this event, together with any costs including legal fees that may be incurred as a result of any such claim whether valid or not; and
(b) indemnify and hold harmless the releasees and each of them against any such claim that I or my guests or any one or more of my executors, administrators, heirs, next of kin, successors and assigns may have or assert and against any costs including legal fees with respect to such claims.
If I am in breach of the terms of entry I agree to recompense the appropriate party and all loss and damage (including legal fees) arising out of such breach, including any damage to the party’s reputation.
I acknowledge that participating or volunteering in this event may involve a real risk of serious injury or even death from various causes, including but not limited to over exertion, dehydration, falls, contact with other participants, spectators or road users, effect of weather, traffic, and conditions of the road. I, for myself and my heirs and executors, hereby waive, release and forever discharge the event organisers, sponsors, promoters, registration company and each of their agents, representatives, successors and assigns, and all other persons associated with the event, for all my liabilities, claims, actions, or damages that I may have against them arising out of or in any way connected with my participation in this event.
I attest and verify that I am physically fit and have sufficiently trained for the Event and its related activities and that I have not been advised by a qualified medical practitioner not to enter.
I understand while Event Organisers have their own public liability insurance, this does NOT include personal accident insurance, ambulance cover or equipment damage/replacement if required. Event Organisers have strongly recommended that I take out my own insurance to cover these items for the purpose of participating in the event, and by continuing to enter, I confirm I understand and agree to this statement and the risks involved.
I acknowledge that I am not (and no other person is) entitled to a refund or credit of any nature in relation to the entry fee(s) I have paid (for myself or another person), for any reason whatsoever, or in any circumstances, unless and to the extent that the Event Organiser is required to provide a refund or payment at law.
I acknowledge that the Event Organiser is entitled to deduct administrative, legal, operational and other costs from any amount (if any) I would be entitled to receive by way of refund (if payable at law).
I hereby agree that in the event of a race cancellation due to storm, rain, inclement weather, winds or other “Act of God” conditions, my entry fee shall also be non-refundable.
I am fully aware this event is conducted on public pathways and roads and as such agree to abide by normal Queensland road rules at all times throughout my participation.
I am also aware of the restrictions on types of equipment permitted for participation in the running events (No rollerblades, skates, skateboards or scooters will be permitted), as well as the race etiquette.
I understand that Event organisers may change the event format, course, times or other event conditions at their discretion. If that occurs, this agreement applies to the changed conditions.
I agree that promotional products provided as part of my registration, such as confirmed merchandise items, do not form part of my entry into the event. However should the promoter not be able to deliver the said items, they agree to provide alternative promotional products at the same face value or more.
Advertised event distances are approximate guides only and should not be used as comparison to officially ratified courses.
STAY SAFE WHEN WALKING AND RUNNING
For the safety of you, other participants, volunteers, local residents and the general community, you are advised to follow the safety tips below:
• Abide by the event and road rules. This includes, but is not limited to, adhering to speed limits, obeying traffic signals and remaining on the walkways at all times where able to do so.
• Listen to and obey directions from Police and course marshals.
• If entered in a run or walking event, competitors should be mindful of correct participation etiquette: • Position yourself at the start line relative to your ability to allow a smooth start for all and so that faster participants are not impeded. • Keep to the left of the course to allow people to pass on the right. • Do not stop or change directions suddenly. • Be courteous to your fellow participants at all times. • Always follow the directions of marshals, officials and emergency service personnel.
• It is the participants responsibility to follow the sign posted course.
• Your equipment must be mechanically sound and in full working order.
• Wear bright clothing that increases your visibility to other participants and/or road users.
• Remember to drink plenty of water and to eat healthy food before, during, and after the event.
I accept and understand full responsibility is with the participant in familiarising themselves with the course before the event and following the directions/courses advertised.
I consent to the publication and/or use in any form of media whatsoever of my name, image, voice, statements or otherwise, without payment or compensation.
The organisers retain the right to refuse or disqualify entry into the event at any time.
I have voluntarily entered into this agreement and by entering I agree that I have read, understood and acknowledge the terms of entry including the warning, exclusion of liability, release, indemnity and information provided elsewhere in the registration form.
I am aware that my contact information may also be used for event or marketing purposes by the Event Organiser(s) or affiliated parties such as sponsors and/or charities – for this event and/or other event organiser’s events. In providing my contact information and email address, or those of my friends, family, or other parties for the purpose of event promotions or prizes, I confirm I have secured their consent and provide my own by completing the entry. I also understand I can request the removal of such provided information by emailing the event organisers at any time.
I acknowledge that if I am under 18 years at the time of entering the Event, my parents/guardian have accepted the terms of entry on my behalf, and by doing so agree that my participation will be supervised continuously by an adult and that failure to provide this at any time, voids your entry at the event.
